Wedding Portrait Overview

 

1. This agreement constitutes an order for wedding portraiture services, including the capture of wedding photos as agreed to by both parties: Luke Myers [known as “Photographer"] and Client. In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement. This agreement serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. Upon signing of this agreement, Client will be offered a print release for the reproduction of delivered images, limited to personal use.

2. If the photographer, Luke Myers, is unable to perform any or all of the duties herein for any reason, including but not limited to, acts of God, accident, illness, theft, transportation failure or technical problems, and if Photographer cannot provide another competent professional, all money received by Photographer, minus expenses or work already completed, will be returned to Client and Photographer shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by under this Agreement during the time preceding the date on which such liability arises.  Client agrees that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re-shoot.

 3. On signing of this agreement by both parties hereto, Photographer will reserve the time agreed upon and will not make another reservation for the specific time frame.

 4. A 20% retainer is needed to secure Client’s date and time of wedding.  The 20% retainer is non-refundable in the event of cancellation or date change.  The 20% retainer covers the time spent coordinating pre wedding arrangements and securing a date which would otherwise be available to other clients. The retainer is due upon signing and will be applied towards the total amount billed. The remaining balance is due seven (7) days prior to the wedding date. The amount agreed upon covers Photographer’s time, proofing and editing. Purchased coverage begins upon Photographer’s arrival at venue and runs without interruption. For local events requiring travel, the initial sixty (60) miles of round trip travel are included at no additional charge. All miles in excess of sixty (60) miles round trip are invoiced at $0.30 a mile, calculated from zip code 46808.

5. It is understood that Luke Myers shall be the exclusive photographer hired for the event. Photographer may bring an assistant at their discretion. Wedding guests may take personal photos, but it is the responsibility of Client to prevent wedding guests from interfering with Photographer's duties. Photographer is not responsible for compromised coverage due to causes beyond their control such as (but not limited to) flash photography from wedding guests, weather conditions, schedule complications, or restrictions concerning the venue or officiant. Photographer is not responsible for physical appearance or wardrobe of subjects. Photographer is not responsible for existing backgrounds or poor lighting conditions (which may negatively impact or restrict the photography coverage). Maximum light is suggested for best results indoors for ceremonies, formals, and receptions.

 6. It is understood that images will be captured and presented using Photographer’s artistic discretion. Photographer retains the right to refuse to capture images contrary to their photographic style. Every effort will be made to assure satisfaction according to the Photographer’s professional standards. However, Photographer is not responsible for subjective interpretations of photography.

7. It is understood that images determined by the photographer to be duplicate or otherwise substandard will not be delivered. Photographer will use their professional judgment and sole discretion to select which photos to deliver, and such selection shall constitute all images that will be made available to Client. The curated images will be delivered to Client digitally via an online gallery.

 8. It is understood that an itinerary must be provided to Photographer at least seven (7) days before the wedding date, and that Client is willing to contact Photographer at that time to confirm scheduling and expectations.
